On Thursday, a Niagara County State Supreme Court judge struck down New York’s new public financing program on the grounds that the delegation of lawmaking authority to the commission created to design the program was unconstitutional. This decision resolved lawsuits filed in 2019 by the Working Families and Conservative parties challenging the Legislature’s delegation of authority to such a body. Following the decision, advocates called for the Legislature to immediately pass legislation ensuring the future of the program.
